Please read these Terms of Service ("Terms") carefully before using the G1 Ace mobile application (the "App") operated by Akosa Digital Inc. ("we," "our," or "us").

1. Acceptance of terms

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Eligibility

You must be at least 13 years of age to use this App. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms on your behalf. By using the App, you represent that you have the legal capacity to enter into this agreement.

3. Description of service

G1 Ace is a study aid application designed to help users prepare for the Ontario G1 written knowledge test. The App provides:

Practice questions based on the Official MTO Driver's Handbook
Exam simulations
Progress tracking
Study resources

4. Educational purpose only - Important disclaimer

G1 Ace is an educational study tool only.

We are not affiliated with, endorsed by, or officially connected to the Ontario Ministry of Transportation (MTO), DriveTest centres, or any government agency. When we use "G1" in our name, we are not claiming government endorsement, sponsorship, or sanction.

You acknowledge and agree that:

The App does not guarantee that you will pass the official G1 test
Practice questions are based on publicly available information from the Official MTO Driver's Handbook and may differ from actual test questions
Passing scores in the App do not reflect official test requirements
We cannot predict or assure specific questions, answers, or results on the official examination
Always refer to the official MTO Driver's Handbook for authoritative information

Our practice tests are intended for training and learning purposes only. Each person has different learning abilities and capacities, and test results depend on many variables including preparation, rest, physical and mental condition, and circumstances on test day. While our program is designed to effectively prepare you for the test, the official Driver's Handbook and Ontario motor vehicle laws are the sole official authority governing the test material.

5. Subscriptions and payments

5.1 Subscription plans

G1 Ace offers the following auto-renewable subscription options:

Weekly: $4.99 CAD per week
Monthly: $9.99 CAD per month
Annual: $24.99 CAD per year

Prices may vary by region and are subject to change. We will provide at least 30 days' notice before any price increases take effect for existing subscribers.

5.2 Free content

The App includes free practice questions that do not require a subscription. Premium content requires an active subscription.

5.3 Payment processing

All payments are processed by Apple through the App Store. By subscribing, you agree to Apple's terms and conditions for in-app purchases. We do not have access to your payment information.

5.4 Auto-renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

5.5 Billing grace period

If your payment method fails, Apple may provide a grace period during which you retain access while payment is retried. Access ends if payment is not successfully processed within the grace period.

5.6 Free trials

If offered, free trials convert to paid subscriptions unless cancelled before the trial ends. You will be notified of any charges before they occur.

5.7 Managing subscriptions

You can manage or cancel your subscription at any time through your Apple ID account settings:

Open the Settings app on your device
Tap your name at the top
Tap "Subscriptions"
Select G1 Ace to manage or cancel

5.8 Refunds

Refund requests are handled by Apple according to their refund policy. We do not process refunds directly. To request a refund, visit reportaproblem.apple.com .

6. User conduct

You agree not to:

Use the App for any unlawful purpose
Attempt to reverse engineer, decompile, or extract source code from the App
Share, distribute, or resell access to premium content
Use automated systems to access the App
Interfere with the proper functioning of the App
Attempt to build a similar service by reference to our proprietary content
Collect or store personal data about other users without consent
Use or attempt to use another person's account
Distribute any material containing software viruses or malicious code

7. Intellectual property

All content in the App, including but not limited to text, graphics, logos, and software, is the property of Akosa Digital Inc. or its licensors and is protected by copyright and other intellectual property laws.

We grant you a non-exclusive, non-transferable, revocable license to use the App for personal, educational, and non-commercial purposes only. This license does not transfer any ownership rights to you.

Road sign images and regulatory information are based on publicly available government resources.

8. Disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability or fitness for a particular purpose
Warranties that the App will be uninterrupted or error-free
Warranties regarding the accuracy or reliability of content
Warranties that you will pass the official G1 test

In plain terms: We work hard to provide accurate, helpful practice questions, but we cannot guarantee the App is perfect or that using it will result in passing the official test.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AKOSA DIGITAL INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Loss of profits or data
Failure to pass the official G1 test
Any damages arising from your use or inability to use the App

Our total liability shall not exceed the greater of $50 CAD or the amount you paid for the App in the 12 months preceding the claim.

In plain terms: If something goes wrong, our maximum responsibility is limited to what you paid us. We are not responsible if you don't pass the official test.

10. Indemnification

You agree to indemnify and hold harmless Akosa Digital Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App or violation of these Terms.

11. Force majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from causes beyond our reasonable control, including but not limited to: natural disasters, government actions, internet or telecommunications failures, power outages, Apple App Store outages, or other force majeure events.

12. Dispute resolution

If you have a dispute with us:

Contact us first at support@g1ace.ca with a description of your concern
We will respond within 48 hours and work to resolve the issue informally
If unresolved after 30 days of good-faith negotiation, either party may pursue legal remedies

We strongly encourage resolving disputes amicably before pursuing formal legal action.

13. Class action waiver

You agree that any dispute with us will be resolved on an individual basis. You waive any right to participate as a plaintiff or class member in any class action, class arbitration, or consolidated or representative proceeding. Class arbitrations, class actions, private attorney general actions, and consolidation with other claims are not permitted under these Terms.

14. Changes to terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the new Terms in the App and updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the new Terms.

15. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or the App. Upon termination, you must cease all use of the App.

16. Governing law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Ontario, Canada, and you consent to the exclusive jurisdiction of those courts.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving its intent.

18. No waivers

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it later. Any waiver must be in writing and signed by us to be effective.

19. Assignment

You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign our rights and obligations under these Terms to any affiliate or successor without your consent.

20. No third-party beneficiaries

These Terms do not create any third-party beneficiary rights in any person or entity that is not a party to this agreement.

21. Electronic communications

By using the App, you consent to receive electronic communications from us (such as email responses to support requests). You agree that all agreements, notices, and communications we provide electronically satisfy any legal requirement that such communications be in writing.

22. Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Akosa Digital Inc. regarding the use of the App, superseding any prior agreements.
